Eskit respects the intellectual property rights of others and expects users to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law.
Eskit offers various subscription plans. By selecting a subscription plan, you agree to pay the applicable fees. All fees are exclusive of taxes unless stated otherwise.
Subscription fees are billed in advance on a recurring basis, based on your selected plan. You authorize Eskit to charge your payment method for these recurring payments.
If we are unable to charge your payment method, we may suspend or terminate your access to the service. You will remain responsible for all unpaid fees.
Eskit reserves the right to change the fees for any services with reasonable notice.
You may terminate your account at any time by following the instructions on the Eskit platform or by contacting our customer support.
Eskit may terminate or suspend your account and access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, Eskit, or third parties, or for any other reason.
Upon termination, your right to use the service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ESKIT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, ESKIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL ESKIT'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE AMOUNT PAID BY YOU TO ESKIT DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH LIABILITY.
You agree to indemnify, defend, and hold harmless Eskit, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the service.
Eskit reserves the right to modify these Terms at any time. We will provide notice of significant changes through the service or by other means. If you continue to use the service after such changes, you accept the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Belgium.
